Under the Indian Gaming Regulatory Act, gaming a tribe conducts is supposed to happen on tribal land.   • Amendment 3 hangs over any expansion. Florida’s 2018 amendment gave voters the exclusive power to authorize new “casino gambling,” so adding competitors is a political and possibly constitutional project, not a simple regulatory decision.

That floor, not the percentages, is the figure lawmakers quote, and it flows into the state’s General Revenue Fund rather than an earmarked account.

On your side: a winning wager is taxable income under federal law, and the IRS expects it reported. But Florida has no personal income tax, so a resident who cashes a bet owes zero state tax on the proceeds. Kalshi, Polymarket, and the sports contracts Robinhood distributes through Kalshi sell binary “yes or no” positions on real-world outcomes. Because Kalshi is registered with the Commodity Futures Trading Commission as a Designated Contract Market, it maintains that any Florida resident 18 or older may trade its contracts, sports included, without a state gaming license. As of late July 2026, Florida’s Gaming Control Commission has not issued Kalshi a cease-and-desist, unlike several other states — but AG James Uthmeier has subpoenaed operators, and House Bill 189 aimed at the sector cleared committee before stalling when the session ended.
