Subsection 2 is the provision that closes the door on poker. Idaho Code 18-3801

The criminal statute reinforces the constitution. Idaho Code 18-3801 defines gambling as risking money, credit, deposit or anything of value for gain contingent in whole or in part upon lot, chance, the operation of a gambling device, or the outcome of an event, and it lists poker directly among the prohibited casino games.

The phrase “in whole or in part” is the critical language. In most states, poker advocates argue that the game is predominantly skill and therefore falls outside a chance-based gambling definition. Idaho’s statute forecloses that argument by construction. If chance contributes at all, the activity qualifies as gambling.

The statute does contain an exemption for bona fide contests of skill, speed, strength or endurance. Poker does not qualify, and that is not an interpretation. A federal appeals court has said so directly, as described below.

What This Means for Individual Players

Under Idaho Code 18-3802, participating in gambling is a misdemeanor. The maximum exposure is six months in jail and a $1,000 fine.

In practice, enforcement is directed at operators, not at individuals playing from home. Public records show no cases of Idaho prosecuting a resident for playing online poker on a personal computer. Idaho’s treatment of daily fantasy sports illustrates how broadly the state reads its gambling definition. In 2016, then-Attorney General Lawrence Wasden concluded that paid DFS contests constitute illegal gambling under Idaho law. Both DraftKings and FanDuel agreed to stop offering paid contests to Idaho consumers effective May 1, 2016. Neither has returned. If a skill-heavy contest with no house bank could not survive Idaho’s statute, poker was never going to.

The Federal Layer

Two federal laws come up constantly in this discussion, and both are widely misunderstood:

• The Unlawful Internet Gambling Enforcement Act of 2006 regulates financial institutions and payment processors. It does not create a federal offense for individual players. Its practical effect on Idaho players is that credit card deposits to offshore poker sites frequently decline, which is why nearly every offshore room now pushes cryptocurrency.

The tribe’s position was straightforward: poker is a peer-to-peer contest of skill with no house bank, which would make it Class II gaming under the Indian Gaming Regulatory Act and therefore outside the state’s compact authority. The casino had watched business drain toward card rooms and tribal poker rooms across the border in Washington.

Gov. C.L. “Butch” Otter and Attorney General Lawrence Wasden sued in federal court within days. In September 2014, U.S. District Judge B. Lynn Winmill granted a preliminary injunction halting the games.

The tribe appealed. On July 22, 2015, a unanimous three-judge panel of the 9th U.S. Circuit Court of Appeals affirmed. Writing for the panel, Judge Michael Daly Hawkins held that although skill undoubtedly plays a role in Hold’em, the game does not qualify for Idaho’s statutory exemption for bona fide contests of skill, speed, strength or endurance. Because the Idaho Constitution and gambling statute explicitly prohibit poker, the court reasoned, Hold’em could not be Class II gaming. Both sides moved to close the case that September.

The poker room shut down and never reopened. Responding to the ruling, Coeur d’Alene Tribal Chairman Chief Allan observed that the decision effectively meant everyone playing poker in the state of Idaho is breaking the law.

That case is why there is no live poker anywhere in Idaho today, tribal or otherwise, and it is why the skill-game argument that has won concessions in other states is a dead letter here.

There is no realistic near-term path to regulated online poker in Idaho, and the reason is structural rather than political mood.

The Constitutional Barrier

Because Idaho’s prohibition sits in the constitution rather than in statute, legalizing online poker would not require a bill. It would require a constitutional amendment: a two-thirds supermajority in both the Idaho House and Senate, followed by approval from voters in a statewide referendum. That is a dramatically higher bar than the simple-majority legislation that legalized online poker in Nevada, New Jersey, Delaware, Pennsylvania, Michigan and West Virginia.

No Legislative Movement Whatsoever

Idaho has not legalized sports betting, which in nearly every other state served as the gateway to broader online gambling discussions. Not one sports betting bill has been introduced in the Idaho Legislature since the U.S. Supreme Court struck down PASPA in 2018. • Sage Hill Travel Center and Casino and Bannock Peak Casino (Fort Hall area), Shoshone-Bannock Tribes. Smaller machine-only venues.

Note the distinction that trips people up: video poker and electronic table games are available at several of these properties. Those are machine games against a computer, not live poker against other players. A video poker terminal at Kootenai River Inn is legally a video gaming machine, not a poker room.

Minimum age is 18 at most Idaho tribal properties, but the Nez Perce casinos require 21. Confirm before driving.

Home Games

Idaho has no social gambling exemption, so private home poker games are technically illegal even with no rake and no host profit.
