Lawmakers and the NCAA have pushed nationally to restrict college player props over integrity concerns, and North Carolina has debated tightening its rules. A roster of University of North Carolina System athletic departments also draws fixed annual payments, and SB 257 both raised those per-school amounts and added the two biggest names, NC State and UNC-Chapel Hill, to the list. The remaining balance flows largely to the state’s General Fund, which is projected to collect the single largest share.

On the bettor side, your winnings are ordinary income. North Carolina taxes them through its flat state income tax, which applies the same rate to every filer rather than a graduated scale, and the IRS taxes them federally on top of that. December 2025 produced $665.9 million in handle, and the market carried that momentum into 2026, with March handle around $726 million. That trajectory explains the tax hike and the intense competition among the seven books. It also means promotions stay generous, because operators are still fighting for market share in a young, growing market. FanDuel and DraftKings command the largest shares, with BetMGM, Caesars, bet365, Fanatics and theScore Bet dividing the rest. Whether the field grows back toward the 12-license cap depends on whether new entrants judge the higher tax worth the opportunity.

North Carolina has landed in a genuinely unusual spot on prediction markets, and it is worth understanding because the state chose to embrace what most others are still fighting. Exchanges such as Kalshi, Polymarket and Robinhood’s event-contract product let users trade yes-or-no contracts on outcomes, including sports results, and they answer to the Commodity Futures Trading Commission rather than to the State Lottery Commission. Because that federal registration is what makes them lawful, Kalshi and its peers have remained reachable to North Carolina residents the whole time, sitting entirely outside the House Bill 347 licensing system.

Then North Carolina went a step further than any other state. Senate Bill 257, the 2026 budget signed on July 7, 2026, wrote into state statute that the Commodity Exchange Act gives the CFTC exclusive federal regulatory authority over these markets, meaning a CFTC-registered platform may operate here without any state license, registration or extra approval. That makes North Carolina the first state in the country to formally recognize CFTC-regulated prediction markets in its own law rather than trying to shut them out with a cease-and-desist campaign. The same budget attached a price of admission: a 6% tax on each operator’s net trading fee revenue tied to North Carolina residents, taking effect January 1, 2027. The contrast is deliberate, since a licensed sportsbook next door pays 23%.

Not everyone in state government is comfortable with the posture. Attorney General Jeff Jackson has put his name to multi-state court filings arguing that sports-outcome contracts run contrary to the public interest and need firmer federal supervision, and his office declined to comment when the budget provision landed, pointing back to those briefs.
