Illinois Poker Sites: Laws, Real Money Options and Where to Play in 2026

No. As of August 2026, Illinois has no regulated online poker, no licensed operators and no legal pathway for a poker site to serve residents. This is not a technicality or a gray area at the operator level. It is settled.

What the Statute Says

Article 28 of the Illinois Criminal Code defines gambling in unusually broad terms. Under 720 ILCS 5/28-1(a)(1), a person commits gambling when he or she knowingly plays a game of chance or skill for money or anything else of value, unless the activity falls under one of the exceptions in subsection (b). Most states draw a line between chance and skill. Illinois does not, which forecloses the skill-game argument poker advocates use elsewhere.

Subsection (a)(12) addresses the internet directly. It is unlawful to knowingly establish, maintain or operate an internet site that permits a person to play a game of chance or skill for money or other things of value, or that permits a person to place a wager online. That provision is aimed squarely at operators, and it is the exact statute the Illinois Gaming Board cited when it went after 65 online gambling platforms in early 2026.

Operating a Site Versus Playing on One

This distinction drives everything. The plain text of subsection (a)(1) reaches players, since playing a game of skill for money is gambling under the definition. But enforcement in Illinois has been directed at operators, hosts and organizers, not at individuals playing from home. There is no publicly documented case of an Illinois resident being charged for playing online poker on an offshore site. Illinois State Police and the Gaming Board have devoted their resources to unlicensed platforms, illegal machines and organized games.

Legal Age

The minimum age for casino gambling in Illinois is 21, which covers every live poker room in the state. The Illinois Lottery and pari-mutuel horse racing are open at 18. Offshore rooms set their own thresholds, and most accept players at 18, though some require 21. That is an operator policy, not an Illinois legal permission.

Penalties

Gambling in violation of Article 28 is a Class A misdemeanor in Illinois, punishable by up to a year in county jail and a fine of up to 2,500 dollars. A second or subsequent conviction under subsections (a)(3) through (a)(12), which includes the internet provision, is a Class 4 felony carrying one to three years in prison and fines up to 25,000 dollars.

Illinois Has No Social Gambling Exemption

This surprises people, and it is one of the most consequential facts on this page. Most states carve out private social games where no one takes a rake and everyone at the table is a bona fide participant. Illinois does not. The Loss Recovery Statute

Illinois retains an unusual civil provision at 720 ILCS 5/28-8. A person who loses money gambling can sue to recover it from the winner. If the loser does not sue within six months, a third party may bring the action and recover treble the amount lost. The statute is a relic and has been narrowed by the courts, which have held that a platform providing the game is not a “winner” for these purposes. It is worth knowing it exists, particularly if you host games.

What Is Legal in Illinois

• Casino gambling under the Illinois Gambling Act, 230 ILCS 10, formerly the Riverboat Gambling Act. Legal riverboat gaming was authorized in 1990 and the first casino opened in Alton in 1991.
• Video gaming terminals under the Video Gaming Act, in licensed bars, restaurants, truck stops, fraternal organizations and veterans groups. More than 50,000 machines are installed statewide and the industry is worth over 3 billion dollars annually.
• Sports wagering under the Sports Wagering Act, retail and online, since 2020.
• Charitable poker under the Charitable Games Act, administered by the Illinois Department of Revenue. The act lists 14 permitted games and poker, five-card stud and hold’em are among them.
• The Illinois Lottery, including online ticket sales, and pari-mutuel horse racing.

Federal Law and Illinois Players

The Wire Act of 1961 targets the transmission of bets across state lines by wire communication. The Department of Justice issued an opinion in 2011 limiting it to sports betting, reversed that position in 2019 and has since been constrained by litigation. It has never been used to prosecute an individual poker player.

UIGEA, passed in 2006, does not make online gambling illegal. It prohibits businesses from knowingly accepting payments connected to unlawful internet gambling, which is why banks and card processors began blocking these transactions and why offshore operators pivoted so heavily to cryptocurrency.

Black Friday, April 15, 2011, saw federal indictments unsealed against the largest online poker operators serving the United States. The resulting vacuum is the direct reason PaiWangLuo and Chico occupy the position they hold today.

Where Things Stand

Nothing passed. The 2026 spring session adjourned June 1 and the only gambling bill to clear both chambers was Senate Bill 3019, which extended operations at the temporary Chicago and Waukegan casinos, adjusted sports betting rules and addressed prediction markets and fantasy contests. Online casino and online poker were not in it. Real-money iGaming remains illegal in Illinois.

HB 4797, the Internet Gaming Act

Rep. Edgar Gonzalez Jr. filed HB 4797 on Feb. 2, 2026. It was the fourth attempt at essentially the same framework since 2021, and the text was substantively identical to the 2025 version. Key provisions:

• A 25% tax on adjusted gross internet gaming revenue, with free play and promotional credits deductible.
• Each of the state’s casino and racetrack licensees permitted three individually branded skins, allowing up to 51 platforms statewide.
• A 250,000-dollar initial license fee and a 100,000-dollar renewal fee.
• A 21-and-over minimum with in-state physical presence required.
• Internet games defined to include slot-style games, table games, poker and live dealer products.
• The Illinois Gaming Board required to adopt emergency rules within 90 days and issue temporary licenses within 30 days.
• A workforce clause barring any licensee that had cut its workforce by 25% or more since Feb. 28, 2020, from receiving a license, with a parallel restriction on renewals.

The bill got a first reading Feb. 6, was assigned to the House Gaming Committee on March 4 and missed the March 27 deadline to clear a substantive committee. It was re-referred to the Rules Committee under Rule 19(a), the procedural mechanism the Illinois legislature uses to shelve a bill without formally killing it.

HB 4802, the Standalone Poker Bill

Gonzalez filed a companion measure, HB 4802, dedicated specifically to legalizing online poker. Its most important feature for players is a provision authorizing the Illinois Gaming Board to enter into agreements with other states for multi-jurisdictional internet gaming. That is the language required to join the Multi-State Internet Gaming Agreement, and it is the difference between an isolated Illinois player pool and a shared national one.

Why It Keeps Failing

The opposition is not moral, it is economic. Illinois built a video gaming terminal industry that now spans more than 50,000 machines in neighborhood bars, restaurants and truck stops across the state. That industry has an effective lobby and argues that phone-based casino gaming would pull foot traffic away from small businesses. Land-based casino operators, including Penn Entertainment, and hospitality labor unions have made parallel cannibalization and job-loss arguments. In the March 2025 committee hearing on the predecessor bill, that coalition held.

The counterargument, made by FanDuel lobbyists and other proponents, is that illegal online gambling is already happening at scale in Illinois and the state collects nothing from it. The February 2026 enforcement sweep gave that argument some fresh evidence.

What Is Pushing It Forward

Money, mostly. Illinois has been working against multibillion-dollar budget gaps, and supporters have projected iGaming revenue in the range of 800 million dollars to more than 1 billion dollars annually. Gov. J.B. Pritzker has called online casino legalization worthy of consideration. Attorney General Kwame Raoul told the National Council of Legislators from Gaming States in July 2025 that he expects online casino gaming to be legalized in Illinois at some point. The state has also demonstrated willingness to reach for gambling revenue, raising the sports betting tax from a flat 15% to a graduated 20% to 40% structure in July 2024 and adding a first-in-the-nation per-wager excise tax in July 2025.

Older Bills Worth Knowing

Realistic Timeline

Illinois runs two-year legislative sessions, so shelved bills are not automatically dead. But four consecutive failures against the same coalition is a pattern, not bad luck. The most plausible route to legalization is a budget year severe enough that leadership decides to spend political capital, combined with a negotiated settlement that gives the video gaming industry something in return. Anyone giving you a specific launch date is guessing.

What Illinois Would Gain From MSIGA

Six states currently participate in the Multi-State Internet Gaming Agreement: Nevada, Delaware, New Jersey, Michigan, Pennsylvania and West Virginia. Pennsylvania joined in April 2025, becoming the largest member and bringing the shared population above 38 million. The compact lets licensed operators combine player pools across state lines, which is what makes tournament guarantees and off-peak cash games viable. Illinois has roughly 12.5 million residents. Adding it to that pool would be the single largest expansion in the compact’s history and would materially change the U.S. regulated poker landscape.

The Two Networks That Matter

Nearly all offshore poker traffic available to Illinois players sits on one of two networks.

PaiWangLuo, formerly the Bodog network, powers Ignition, Bovada and Bodog. Its defining feature is the recreational player model: anonymous tables, Quick Seat random table assignment, and active restriction of third-party tracking software. It is the highest-traffic U.S.-facing network and the softest, and it is deliberately hostile to professional grinders.

What to Verify Before You Deposit Anywhere

• Whether the operator currently accepts Illinois registrations. Restricted-state lists change without announcement.
• The clearing mechanism and expiry window on any bonus, because rake-based release is not the same as bonus cash.

How the Model Works

The legal theory is that no purchase is required to obtain the redeemable currency, which places the product under promotional sweepstakes law rather than gambling law.

The February 2026 Crackdown

This is the most important recent development for Illinois players and much of the content published elsewhere has not been updated to reflect it.

On Feb. 5, 2026, the Illinois Gaming Board, coordinating with the office of Attorney General Kwame Raoul, issued 65 cease-and-desist letters to operators it accused of running illegal online casino and sweepstakes gaming platforms in Illinois. The letters cited 720 ILCS 5/28-1(a)(12) and stated that Illinois authorizes gambling only at riverboats and casinos with an owner’s license, racetracks with an organization gaming license, sportsbooks licensed under the Sports Wagering Act and establishments licensed under the Video Gaming Act. Each letter demanded the operator block Illinois residents or stop offering cash, gift cards and other prizes, and warned that failure to comply could subject the company, its affiliates and its business partners to civil or criminal penalties.

IGB Administrator Marcus D. Fruchter said illegal online gambling operations threaten consumer protections and undermine responsible gaming safeguards. Raoul said the law is clear that gambling in Illinois must be properly licensed and regulated.

Named recipients included Global Poker, Chumba Casino, LuckyLand Slots, Stake.us, Pulsz, High 5 Casino, Fliff, Legendz, Modo, Fortune Coins and Funrize. The full list is published on the Gaming Board’s website. The sweep also captured offshore brands, with a letter filed under JuicyPopSlots (Bovada).

What Happened Next

Almost nothing, at first. By April 3, 2026, only two of the 65 named operators, JefeBet and Jumbo88, had updated their geoblocking to restrict Illinois. That is a compliance rate of roughly 3%.

The reason is strategic. A cease-and-desist letter is a demand, not a court order. Ignoring one forces the Gaming Board to bring civil or criminal proceedings, where the definition of a sweepstakes under Illinois law has never been squarely tested by a court. The industry’s position is that free-entry promotional play is not gambling. The state’s position is that a dual-currency platform paying cash-redeemable prizes is an unlicensed online casino. Neither has been resolved.

Departures have since trickled in. Smiles Casino was the first named operator to formally restrict Illinois access, followed by WOW Vegas, Spin Saga, Rolla Casino, Rolling Riches and Carnival Citi. Blazesoft pulled Sweeps Coins play from Illinois across its brand portfolio, which includes Zula Casino, Sportzino, American Luck and others. A number of major platforms have continued to serve the state.

SB 1705

Sen. Bill Cunningham’s Senate Bill 1705 would amend the Illinois Criminal Code so that the definition of a gambling device expressly includes any electronic device offering entry into a contest, competition or sweepstakes scheme involving an element of chance and rewarding players with something of value. An amendment in the Gaming, Wagering and Racing Committee extended that to gaming conducted online. Offenses would be a Class 4 felony, carrying one to three years in prison and fines up to 25,000 dollars.

The bill advanced through committee in 2025 but did not pass. Because Illinois runs two-year sessions it survived as a carryover into 2026, and Illinois filed no new standalone sweepstakes prohibition bill before the Feb. 6, 2026 introduction deadline. SB 1705 did not pass during the spring session either. If it becomes law, the operators currently ignoring the cease-and-desist letters lose their legal basis for doing so. Until then, the standoff holds.

The Practical Position for Illinois Players

Sweepstakes poker in Illinois is now a materially worse proposition than it was a year ago. Global Poker, which was the primary sweepstakes poker product in the United States, was named in the sweep. The state has declared the entire category illegal. Platform availability can change overnight, and if a platform exits with a balance in your account, redemption windows are short. If you use these sites, keep redemptions current rather than accumulating Sweeps Coins.

Free-Play Poker

Pure play-money poker apps involve no wagering, no prizes and no legal question. They are useful for learning hand mechanics and nothing else. Play-money games bear almost no resemblance to real-money strategy, because opponents with no financial stake do not fold.

Illinois has 15 operating casinos with additional licenses issued but not yet open. Nine of them spread live poker. Every one is regulated by the Illinois Gaming Board, and the minimum age at all of them is 21 with a valid government photo ID required.

It is the busiest room in the state, sits near O’Hare International Airport and runs a regular tournament schedule alongside its cash games. Jointly owned by Churchill Downs and Rush Street Gaming.

Grand Victoria Casino, Elgin

A close second and arguably the better tournament destination. The World Series of Poker Room carries 20 live tables, tableside dining and a full bar, and Grand Victoria hosts WSOP Circuit events twice a year, each with more than 2 million dollars in guaranteed prize money. The Caesars-owned riverboat sits on the Fox River about 40 miles west of Chicago. Cash games run hold’em and Omaha.

Other Illinois Poker Rooms

• Hollywood Casino Aurora, on the Fox River, one of the original 1993 riverboats, with a poker room in the mid single digits for table count and steady local traffic.
• Wind Creek Chicago Southland in East Hazel Crest, opened November 2024, the state’s newest major property with 56 table games and a poker room. It posted 198 million dollars in its first full year.
• Hard Rock Casino Rockford, six tables, positioned near three interstates and roughly equidistant from Chicago, Madison and Milwaukee, which the property has cited as a tournament-hosting advantage.
• Bally’s Quad Cities in Rock Island, six tables, the former Jumer’s property.
• Par-A-Dice Hotel Casino in East Peoria, a five-table room and the main option in central Illinois.
• Hollywood Casino Joliet, a small room and the poker option in Joliet since Harrah’s Joliet closed its room permanently in 2020.
• Bally’s Chicago, currently operating from the temporary Medinah Temple venue in River North.

Bally’s Chicago

The permanent 1.7 billion dollar Bally’s Chicago resort at 777 W. Chicago Ave. is the largest casino development in the state’s history and has slipped repeatedly, with recent reporting pointing to 2026 or 2027. Senate Bill 3019 addressed the timing problem directly, allowing the operators of the temporary Chicago and Waukegan facilities to petition the Gaming Board for extensions on a showing of good cause and a 10,000-dollar administrative fee. The Chicago temporary casino can run up to 24 months plus an additional 18, with authority for the board to grant two further three-month extensions. Read that as an official acknowledgment that the permanent opening is not imminent.

Charitable Poker

Illinois permits poker at licensed charitable gaming events under the Charitable Games Act, administered by the Illinois Department of Revenue rather than the Gaming Board. The act enumerates 14 permitted games and poker, five-card stud and hold’em are on the list. Several dedicated charitable operations run regular schedules, including venues in Downers Grove, Elk Grove Village, Bloomington and Joliet, plus the long-running Windy City Poker Championship in Homewood. Structures, rake and buy-ins differ from casino rooms because the events operate under a different statute and a different licensing regime.

Crossing State Lines

Illinois players in the Chicago area are within short driving distance of Indiana rooms including Horseshoe Hammond and Ameristar East Chicago. Iowa, Missouri and Wisconsin all offer additional options for players in other parts of the state.

Illinois has no operating tribal casinos. That is unusual for a state of its size and it has a specific legal history.

The Native American Gaming Compact Act, 230 ILCS 35/1, requires the governor to submit a request for authority to the General Assembly before entering into any compact authorizing a tribe to conduct gaming in Illinois. No such compact is in force and no tribal gaming operation currently exists in the state.

The Prairie Band Potawatomi Nation is the only federally recognized tribal nation with land in Illinois. In April 2024, the U.S. Department of the Interior placed 130 acres in DeKalb County into trust, restoring a portion of the historic Shab-eh-nay Reservation and making the Prairie Band the only federally recognized tribal nation in Illinois. The land had been illegally auctioned in 1849 while Chief Shab-eh-nay was visiting family in Kansas, and the tribe spent nearly two centuries seeking its return, ultimately paying close to 10 million dollars to buy back the acreage.

In May 2025, Gov. Pritzker signed legislation authorizing the Illinois Department of Natural Resources to transfer title to the roughly 1,500-acre Shabbona Lake State Park to the tribe, which has said the park would continue operating as a public park under its management.

On the question everyone asks: Chairman Joseph “Zeke” Rupnick has said there are no plans at this time for a casino on the DeKalb County site, noting that the location is isolated, surrounded by existing casinos and lacks major highway access. The tribe considered gaming there in the 1990s and previously proposed a bingo facility. Even if that changed, a Class III casino would require a tribal-state compact under the Indian Gaming Regulatory Act, which in Illinois would require the governor to go to the General Assembly first. There is no realistic near-term path to tribal poker in Illinois.

One point of confusion worth clearing up: Wind Creek Chicago Southland is operated by the Poarch Band of Creek Indians, the same tribe behind the Wind Creek properties in Alabama. It is not a tribal casino in the legal sense. It operates on non-trust land in East Hazel Crest under an Illinois commercial gaming license and is regulated by the Illinois Gaming Board like any other state casino.

The State Rules

Illinois taxes gambling winnings as ordinary income at its flat 4.95% rate. That applies to poker cash game profits, tournament cashes, casino wins, sports betting and lottery prizes. Lottery prizes of 1,000 dollars or more have the 4.95% withheld automatically. Since Dec. 31, 2019, Illinois taxes gambling winnings earned in the state regardless of where the winner lives.

The Federal Rules Changed for 2026

Two changes took effect for the 2026 tax year and both matter for poker players.

The 90% loss deduction cap. Under prior law, a taxpayer who itemized could deduct gambling losses up to the amount of winnings. Beginning with the 2026 tax year, only 90% of losses are deductible, still capped at winnings. A player who wins 50,000 dollars and loses 50,000 dollars can now deduct only 45,000 dollars, leaving 5,000 dollars of what practitioners are calling phantom income. This applies to both recreational filers using Schedule A and professionals filing Schedule C, and reporting indicates the 90% limitation extends to non-loss expenses including data service subscriptions.

The W-2G threshold rose to 2,000 dollars as of Jan. 1, 2026, up from the prior level. The Illinois Department of Revenue applies the federal threshold for withholding purposes. Fewer forms will be issued, but the reporting threshold governs what gets reported to the IRS, not what is taxable. Every dollar of winnings is taxable whether a form is generated or not.

Federal backup withholding on gambling winnings is 24%.

Offshore and Crypto Winnings

An offshore poker room will not issue you a W-2G and will not report anything to the IRS. That does not change your obligation. Winnings are taxable income regardless of where the operator is located. Crypto adds a second layer: converting cryptocurrency to dollars can create a separate capital gain or loss event depending on the price movement between acquisition and disposal, tracked independently of the gambling income itself.

Recreational Versus Professional

Recreational players report winnings as other income and deduct losses on Schedule A only if they itemize. Professionals file on Schedule C, can deduct ordinary and necessary business expenses, and are subject to self-employment tax. The classification depends on facts, including regularity, intent to profit and whether poker is your livelihood. It is not an election you simply choose. The 90% cap now applies to both.

Records to Keep

• A contemporaneous session log with date, location, game, stakes, buy-in and cash-out.
• Downloaded hand histories and account statements from every platform.
• Casino player card statements for live play.
• Crypto transaction records including acquisition dates and dollar values.
• Tournament receipts and W-2G forms.

The 90% cap makes documentation more valuable than it used to be. A poorly documented losing year can now cost you real money at both the federal and state level.

State Self-Exclusion Programs

Illinois runs several separate self-exclusion programs, and enrolling in one does not enroll you in the others.

• Casino Voluntary Self-Exclusion through the Illinois Gaming Board, a lifetime ban with the ability to petition for reconsideration after five years.
• Video Gaming Self-Exclusion, covering licensed VGT establishments.
• Sports Wagering Self-Exclusion, covering licensed sportsbooks.
• Illinois Lottery Voluntary Self-Exclusion, minimum five years.

The Offshore Gap

None of these programs reach offshore poker sites or sweepstakes platforms. There is no mechanism to enforce an Illinois exclusion against a company in Panama or Curacao. If you are managing a gambling problem, offshore sites are the hardest environment to control, because the state safety net does not extend to them. Blocking software installed at the device or router level, and third-party bank-level gambling blocks offered by some financial institutions, are the practical tools available.

Operator Tools

Most offshore rooms provide deposit limits, session time limits, cool-off periods and account closure on request. Quality of implementation varies and none of it is audited by a regulator. Setting limits before you start playing is more effective than setting them during a losing session.

Warning Signs

• Playing at stakes above your bankroll to recover losses.
• Borrowing money or using funds set aside for expenses.
• Concealing the extent of your play from people close to you.
• Being unable to stop after a set session length or loss limit.
• Gambling to manage stress, boredom or low mood.
