But the agency has been aggressive, issuing cease-and-desist letters to major brands, and a lot of well-known operators have pulled out of the state as a result. Bills to explicitly ban them were introduced in both 2025 and 2026 and failed to pass, but the regulator clearly wants them gone. So this is legal in the technical sense that no statute prohibits it, contested in the practical sense that the state is squeezing the operators hard. Prediction markets are the most legally tangled item on this page. Platforms like Kalshi operate under federal oversight from the Commodity Futures Trading Commission as derivatives markets, which is how they argue they sit outside state gambling law. Maryland disagrees. The MLGCA ordered Kalshi to stop, Kalshi sued, and the case is now in front of the US Court of Appeals for the Fourth Circuit, with the parties holding the status quo until it is resolved. At the same time, the state is moving to tighten, not loosen, on sweepstakes and prediction markets.
